Terms of Use

1.1 Binding Agreement

By creating an account, accessing, or using any portion of our Services, you represent and warrant that you are at least 16 years of age (or the age of majority in your jurisdiction, whichever is higher) and have the legal capacity to enter into this Agreement. If you are accessing the Services on behalf of an organization, you represent and warrant that you have the authority to bind such organization to these Terms. These Terms apply to all users, including tournament organizers, players, and visitors.

1.2 Modifications to Terms

We reserve the right to modify, amend, or update these Terms at any time, at our sole and absolute discretion, without prior notice. Any changes will be effective immediately upon posting on the Platform. Your continued use of the Services after any such modifications constitutes your binding acceptance of the revised Terms. It is your sole responsibility to review these Terms periodically. We shall not be obligated to notify you of any changes, and your failure to review the Terms will not serve as an excuse for non-compliance.

Padel Chief is a tournament management platform designed for Padel (a racquet sport) that enables users to:

• Create, organize, and manage tournaments in various formats (Rotating Partners, Fixed Teams, Mixed Pairs, Multi-Stage)
• Join and participate in tournaments organized by other users
• Record and track match scores in real-time
• View rankings, ratings, leaderboards, and performance statistics
• Communicate with tournament organizers and other participants
• Access an AI-powered assistant for rules and guidance
• Process tournament entry fee payments on behalf of organisers through our integrated payment gateway
• Provide registration forms for tournament entries, collecting player names, phone numbers, and playing category
• Enable venues and courts to list and manage events through standard user accounts

3.1 Account Registration

To access certain features, you must create an account by providing accurate, complete, and current information. You represent and warrant that all information you provide is truthful and that you will maintain the accuracy of such information. Providing false or misleading information constitutes a material breach of these Terms and may result in immediate account termination.

3.2 Account Security

You are solely and exclusively responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized use of your account or any other security breach. We shall not be liable for any loss, damage, or liability arising from your failure to comply with this security obligation or from any unauthorized access to your account, regardless of whether such access was caused by your negligence or otherwise.

3.3 Account Termination

We reserve the right to suspend, disable, or terminate your account at any time, for any reason or no reason, without prior notice, at our sole discretion. Grounds for termination may include, but are not limited to: violation of these Terms, suspected fraudulent or illegal activity, abusive behavior, inactivity, or any conduct we deem harmful to the Platform or its users. Upon termination, your right to use the Services will immediately cease. We shall not be liable to you or any third party for any termination of your account or access to the Services.

4.1 Acceptable Use

You agree to use the Services only for lawful purposes and in accordance with these Terms. You are solely responsible for your conduct and any content you submit, post, or display on or through the Services.

4.2 Prohibited Activities

You agree NOT to:

• Violate any applicable local, state, national, or international law or regulation
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity
• Engage in any conduct that is fraudulent, deceptive, or misleading
• Manipulate scores, rankings, or tournament results through any means
• Harass, abuse, threaten, or intimidate any other user
• Submit false, inaccurate, or misleading information
• Interfere with or disrupt the Services or servers or networks connected to the Services
• Attempt to gain unauthorized access to any portion of the Services or any systems or networks
• Use any automated means (bots, scrapers, etc.) to access the Services
• Collect or harvest any personally identifiable information from other users
• Use the Services for any commercial purpose not expressly permitted
• Attempt to reverse engineer, decompile, or disassemble any part of the Services
• Circumvent, disable, or interfere with any security features of the Services

5.1 Platform Access

The Padel Chief Platform is currently free to use for creating accounts, organizing tournaments, and accessing basic features. However, participation in certain tournaments may require payment of entry fees as determined by the event organizer. We reserve the right to introduce platform fees, commissions, or subscription plans in the future. Any such changes will be communicated to users with reasonable notice before taking effect.

5.2 Payment Processing

Payments on the Platform are processed through OnePay, an intellectual property of Spemai (PVT) Ltd (PV Number PV 00206829), a company incorporated under the laws of Sri Lanka and regulated by the Central Bank of Sri Lanka.

When tournament entry fees are collected through the Platform, Padel Chief (PVT) Ltd receives the payment on behalf of the organiser and disburses the applicable amount to the organiser within seven (7) days following the conclusion of the event.

By submitting payment information, you authorise Padel Chief (PVT) Ltd and OnePay to process the transaction on your behalf.

Padel Chief is not a bank, financial institution, or money services business. We do not hold funds in trust or escrow.

We do not store complete payment card details (card numbers, CVV, etc.) on our servers. All sensitive payment data is handled directly by OnePay.

5.3 Fee Collection

For Official Padel Chief Events: Entry fees are collected directly by Padel Chief (PVT) Ltd. Fee amounts, payment deadlines, and collection methods will be specified in the event details.

For Community Events (Platform Payments): Where entry fees are collected through the Platform via OnePay, funds are received by Padel Chief (PVT) Ltd and disbursed to the organiser within seven (7) days after event conclusion. Padel Chief may deduct applicable processing fees or platform charges (if any) before disbursement.

For Community Events (Off-Platform Payments): Organisers may also collect fees outside the Platform (e.g., cash, bank transfer). Padel Chief has no involvement in, control over, or liability for payments made outside the Platform.

6.1 Platform Role - Community Events

For Community Events organized by third parties, Padel Chief is solely a digital tool for tournament management and does not organize, host, supervise, or control any physical sporting events or activities. We are not responsible for the safety, conduct, legality, or quality of any community tournament, match, venue, equipment, or participant.All physical activities for community events are independently organized and conducted by third-party organizers and participants.

6.2 Platform Role - Official Events

For Official Padel Chief Events, we assume organizer responsibilities within reasonable limits. However, participation in physical sporting activities always carries inherent risks that cannot be eliminated. By participating in Official Padel Chief Events, you acknowledge and accept these inherent risks.

6.3 Participant Responsibilities

As a tournament participant, you are solely responsible for: assessing your own fitness and ability to participate in physical activities; obtaining any required medical clearances; using appropriate safety equipment; following all rules and instructions provided by organizers; and conducting yourself in a safe and sportsmanlike manner. By participating in any tournament listed on our Platform, you voluntarily assume all risks associated with such participation.

6.4 Rankings and Ratings

Rankings, ratings, and performance statistics displayed on the Platform are calculated using automated algorithms based on reported match results. We make no representations or warranties regarding the accuracy, completeness, or reliability of any rankings or ratings. Rankings are provided for informational and entertainment purposes only and should not be relied upon for any professional, competitive, or official purposes.

6.5 Organiser Obligations

All users who create and manage tournaments on the Platform agree to:

• Provide accurate and complete event details including venue, date, time, capacity, and fees
• Honour published event details or promptly notify registered participants of any material changes
• Handle refund requests fairly for events where payments were processed through the Platform
• Comply with all applicable local laws, regulations, permits, and venue requirements
• Ensure a safe and appropriate environment for participants at their events
• Use registration form data solely for the purpose of managing the specific tournament
• Not create fraudulent events or collect fees without genuine intention to host the event
• Not publish misleading, defamatory, or discriminatory event descriptions or entry requirements
• Not cancel events without reasonable notice to registered participants
• Not use the Platform to facilitate any illegal or harmful activity

6.6 Registration Forms

Organisers may use the Platform's built-in registration forms to collect participant information for their tournaments. Registration forms collect the following fixed fields: player name, phone number, and playing category.

No custom or additional fields are available on registration forms. Organisers may not request sensitive personal data (including but not limited to medical records, government identification numbers, or financial information) through any means facilitated by the Platform.

Registration form submissions are accessible to: (a) the organiser of the specific tournament; and (b) Padel Chief for platform administration, support, integrity monitoring, and moderation purposes. By submitting a registration form, you consent to the organiser and Padel Chief accessing the information you provide for the purposes described above.

6.7 Venue and Court Partnerships

Venues and courts may use the Platform by registering a standard user account through their owner or authorised representative. There is no separate venue account type.

Venue representatives are subject to all the same obligations as individual users and tournament organisers under these Terms.

Padel Chief does not verify, inspect, certify, or guarantee any venue, its facilities, equipment, or compliance with safety standards or local regulations. All representations about venues are made solely by the venue representative.

When a participant registers for a tournament at a partner venue, the participant's registration data (name, phone number, playing category) and publicly available ranking and performance data may be shared with the venue representative for event coordination purposes.

8.1 Our Intellectual Property

The Services, including all content, features, functionality, design elements, graphics, logos, trademarks, and software, are owned by Padel Chief (PVT) Ltd or our licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Services for personal, non-commercial purposes, subject to these Terms.

8.2 User Content

By submitting, posting, or displaying content on or through the Services (including profile information, tournament data, scores, and communications), you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, reproduce, modify, adapt, publish, translate, distribute, display, and create derivative works from such content for any purpose. You represent and warrant that you own or have the necessary rights to grant this license.

12.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Democratic Socialist Republic of Sri Lanka, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of Colombo, Sri Lanka.

12.2 Informal Resolution

Before filing any claim or initiating any formal dispute resolution proceeding, you agree to first contact us at hello@padelchief.com and attempt to resolve any dispute informally. Most disputes can be resolved quickly and amicably through good-faith discussion.

12.3 Waiver of Class Actions

TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AGREE THAT ANY CLAIMS MUST BE BROUGHT IN YOUR INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. You waive any right to participate in a class action lawsuit or class-wide arbitration against us.

16.1 Entire Agreement

These Terms, together with our Privacy Policy, Cookie Policy, and any other legal notices published on the Platform, constitute the entire agreement between you and Padel Chief (PVT) Ltd concerning the Services and supersede all prior or contemporaneous communications, proposals, and agreements, whether oral or written.

16.2 Severability

If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be deemed severable from these Terms and shall not affect the validity and enforceability of the remaining provisions.

16.3 Waiver

No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term. Our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

16.4 Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may freely assign these Terms without restriction or notification.

16.5 Force Majeure

We shall not be liable for any failure or delay in performance due to causes beyond our reasonable control, including acts of God, natural disasters, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or shortages of transportation, facilities, fuel, energy, labor, or materials.
